1. Acceptance of Terms

By creating an account, accessing, or using any part of the GlowScore AI platform ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and GlowScore AI, Inc. ("GlowScore," "we," "our," or "us").

2. Description of Service

GlowScore AI is an artificial-intelligence-powered platform that analyzes facial images to generate an attractiveness score (a "GlowScore") and personalized "glow-up" improvement plans covering skincare, grooming, style, fitness, and wellness. The Service includes, but is not limited to:

• AI-generated facial attractiveness analysis and scoring
• Personalized glow-up roadmaps and actionable recommendations
• Progress tracking via photo comparisons over time
• Curated product and routine suggestions
• Community features and optional social sharing tools

The Service is intended for personal, non-commercial use unless otherwise agreed upon in writing with GlowScore AI.

3. User Responsibilities & Eligibility

You represent and warrant that:

• Age: You are at least 18 years of age. The Service is not directed to individuals under 18. If you are under 18, you must not use or attempt to use the Service.
• Photo ownership: Any photograph or image you upload to the Service depicts only yourself or a person for whom you have obtained explicit written consent to submit their likeness for AI analysis.
• Account accuracy: All information you provide during registration and use of the Service is accurate, current, and complete.
• Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Compliance: Your use of the Service complies with all applicable local, state, national, and international laws and regulations.

4. Prohibited Uses

You agree not to, and will not assist others to:

• Scrape, crawl, spider, or otherwise automatically access any part of the Service or its underlying data
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code or algorithms of our AI models
• Upload images of third parties without their explicit consent, or upload images containing minors
• Use the Service to harass, bully, or demean others based on their appearance
• Circumvent any access controls, authentication measures, or usage limits
• Use automated tools, bots, or scripts to interact with the Service in a manner inconsistent with normal human use
• Sell, resell, sublicense, or commercially exploit any outputs of the Service without our prior written consent
• Transmit viruses, malware, or any other malicious or technologically harmful material
• Use the Service in any way that could damage, disable, overburden, or impair our infrastructure

Violation of these prohibitions may result in immediate account termination and, where appropriate, legal action.

5. Intellectual Property

GlowScore IP: The Service, including its design, software, AI models, text, graphics, logos, and all other content created by GlowScore AI, is owned by or licensed to GlowScore AI, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any GlowScore content without our express written permission.

Your Content: You retain ownership of any photos or content you upload ("User Content"). By uploading User Content, you grant GlowScore AI a limited, worldwide, royalty-free, non-exclusive license to process, store, and analyze your User Content solely for the purpose of providing the Service to you. We will not use your photos to train our AI models or share them with third parties except as described in our Privacy Policy.

AI-Generated Outputs: GlowScore AI retains all rights in the scores, analysis reports, and recommendations generated by our AI. You are granted a personal, non-transferable license to use such outputs for your own personal, non-commercial purposes.

6. Subscription & Payment Terms

GlowScore AI offers free and paid subscription tiers. Paid subscriptions are billed through Stripe, our third-party payment processor. By subscribing to a paid plan, you agree to Stripe's Terms of Service in addition to these Terms.

• Billing: Subscriptions are billed on a recurring monthly or annual basis depending on the plan selected. Your payment method will be charged automatically at the start of each billing period.
• Cancellation: You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.
• Refund Policy: We offer a 7-day money-back guarantee for first-time subscribers on monthly plans. Annual plan subscribers may request a pro-rated refund within 14 days of the initial purchase. After these windows, all sales are final and no refunds will be issued. Refunds are processed via Stripe and may take 5–10 business days to appear on your statement.
• Price changes: We reserve the right to modify subscription prices with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

GlowScore AI scores, glow-up plans, and all other AI-generated outputs are provided for entertainment and informational purposes only. They do not constitute medical advice, dermatological consultation, psychological assessment, or any other professional advice. We make no representations or warranties that:

• AI scores accurately reflect any objective measure of attractiveness
• Recommendations will produce specific results for any individual
• The Service will be uninterrupted, error-free, or free of harmful components
• Defects in the Service will be corrected

You use the Service and rely on its outputs entirely at your own risk. If you have concerns about your skin, health, or wellbeing, please consult a qualified professional.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GLOWSCORE AI, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT WILL GLOWSCORE AI'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO GLOWSCORE AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Termination

You may delete your account at any time through your account settings, which will terminate your access to the Service. We reserve the right to suspend or terminate your account, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent or harmful behavior, or for any other reason we deem appropriate.

Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes.

Before initiating any legal proceeding, you agree to first contact us at legal@glowscore.ai and attempt to resolve the dispute informally for a period of 30 days.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where required by law, by sending a notification to the email address associated with your account. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
